Welcome to my shop and its website operated by Luxrosata AB, reg no. 559529-8075, (hereinafter ‘Luxrosata’, “we”, “us” or “our”), including all related information, content, features, tools, products and services in order to provide you with a curated shopping experience (the “Services”). The shop is powered by Shopify, which enables us to provide the Services to you in a reliable and secure way.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Please note that some of the terms that apply differ based on what type of purchase you make, such as original art, print or other merchandise or digital content - we explain this below where relevant. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website.

1.   General – Access and Account

When placing an order on the sections on the website where purchases can be made, you make a purchase from us. You must be 18 years of age to be allowed to make purchases from us and if you are underaged you must not proceed unless you have your guardians permission.

You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information, included but not limited to your payment methods such as card details. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

If there are any errors in the information displayed on our website, we reserve the right to make corrections thereto, including prices etc. If we make any such corrections that impact an item you have purchased, you may choose to not proceed with the purchase.

2.   Orders, Prices, Payment and Currency

When you place an order, you are making an offer to purchase. We reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we may not be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail and/or phone number provided at the time the order was made.

When you place an order with us you agree to these terms and to pay the price of the goods or services purchased, along with any delivery fees or other costs and charges. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

For purchases within the EU, you will be charged the applicable VAT rate with your purchase. For purchases outside of the EU, sales tax (such as VAT, GST or similar) will not be added to your purchase by us, however you might be responsible to pay such tax on imports.

We trade in Swedish crowns (SEK) which is our home currency. If prices are displayed in your local currency and you make purchases in any other currency than SEK, Shopify, the payment provider or even your own card issuer or similar might add a conversion rate/fee or similar to the transaction.

3.   Purchases, Shipping, Delivery and Risk

The terms will vary depending on whether you purchase original art, prints or other merchandise or digital content or events. You are always fully responsible for any additional costs to us if you refuse or do not collect a shipment.

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

A.   Original Art

A certificate of authenticity will accompany the artwork. Please note that we try and depict the art as well as possible but there might be variations from the photograph, depiction on website and the actual original painting. Be aware that some canvases, particularly jute, is not so densely woven and this can result in the wall behind the painting ‘shining’ through.

i.   Practicalities and Preparation Time Before Shipping

Larger artworks will be shipped in a custom made crate which will be sealed with screws which require you to unscrew them to unseal the crate.

As the crate is custom built after your order is placed, the artwork is generally dispatched for shipping at the earliest after a week or two, but may take longer, especially during Summer or Holidays, however, we do our best to ship as soon as we can. After the art has been shipped, the time of delivery will depend on the shipping company and your location. If the shipping date is crucial to you, please reach out to us before placing an order and we will give you a rough estimated timeline.

ii.  Price, Packaging, Insurance, Tax and Levies

The price of shipping, packaging (and when possible, insurance) is included in the price unless specifically stated. Note that the price of any customs duty, VAT, GST or other sales tax, if applicable, is not included and you are responsible for paying any such fees, charges, levies and your package might not be cleared by customs until you do so.

iii.  We Reserve the Right to Cancel Orders in Certain Locations

We have shipped successfully around the world and aim to ship world wide but we reserve the right to cancel your order if you are based in a country under restrictions or sanctions or where it is difficult or not commercially viable to ship. If your order is cancelled for these reasons a full refund will be processed swiftly after you have been notified thereof and we apologise for any inconvenience.

B.  Prints or Other Merchandise

We try and depict the art as well as possible but there might be variations from the photograph, depiction on website and the actual print produced. Please note that metallic colours (such as gold, silver, bronze or similar) will not be replicated when printing and the printer does it best to produce a substitute which will look different to the image you see on your screen. We use a partner to produce the items of your order on demand and ship it to you. Our partner has locations in several regions of the world and we aim to fulfil your order from the location most optimum to your location.

i.   Shipping Time and Cost

When you add your location, estimated time for shipping and cost shall be displayed at the checkout. Note that the timeframe presented is a best estimate but it may take longer for the items to reach you.

ii.   Tax, Duties etc.

If we cannot ship from within your region, note that any customs duty, VAT, GST or other sales tax, if applicable, is not included in the purchase price or shipping cost and you are responsible for paying any such fees, charges, levies and your package might not be cleared by customs until you do so.

iii.   We Reserve the Right to Cancel Orders in Certain Circumstances

We try and ship to as many countries as possible and if your region is not catered for you should not be able to place an order. If the system accepts your order and we are unable to fulfil it via our partners, we reserve the right to cancel your order and provide you with a full refund which will be processed swiftly.

4.   Right of Withdrawal or Cooling off

This section is only applicable to consumers based in the EU, EEA or UK

  • Events - If you purchase participation at a knowledge-sharing event or similar which is held at a specific date and time, you have no right to withdraw.
  • Digital Content - If you purchase any digital content, you agree to the content being delivered immediately or instantaneously and you therefore forgo any right to withdraw from such purchase.
  • Physical Goods - If you are a consumer who is based in the EU, you have the right to withdraw from your purchase of physical items if you notify us within 14 days of receiving the item. If you want to exercise this right, please send a message to the email address noted below under the heading ‘contact’, making it clear you have regrets and want to withdraw from your purchase. After having received your request we will process it and come back to you with instructions on where in Sweden to send the goods you wish to return. You must ensure that the items you return to us are suitably packaged and protected and you have to arrange transportation and assume the transportation costs as well as the risk during transport. The cost of the return will depend on the size of the package and is estimated at a maximum of SEK 10 000 for original art and SEK 500 for all other items. When we have received the returned items in good condition, we will initiate your refund as soon as possible. If the item has decreased in value, a reasonable deduction will be made otherwise a full refund will be given. Refunds are made using the payment method used for the original purchase.
  • Customer outside the EU/EEA - If you are a consumer based in a country outside of the EU/EEA where you believe you have the right to withdrawal, please notify us and we will investigate if we have an obligation to consider your request. If we are not under a legal obligation, we do not accept your withdrawal after you have placed an order as all items or its packaging, are produced on demand, specifically for you.

5.   Refunds, Replacements and Faulty Goods

We do not offer refunds or exchanges of goods unless an item is damaged, faulty or lost. If you believe you are entitled to a refund you must notify us as soon as possible after taking delivery and;

-     For customers based in the EU, EEA or UK, not later than within 2 months of when you became aware of the fault and never after 3 years,

-     For customers in the rest of the world, not later than 7 days of when you became aware of the fault and never after 30 days.

If an item is damaged in transport you must notify us immediately and never later than 7 days after delivery. If an item is not delivered to you, submit your claim within 30 days of placing your order with us.

6.   Recommendations of Care for Artworks

We use artist quality material but all artworks may deteriorate if not cared for properly. Do not hang art in direct sunlight as this will cause colours to fade. Specific areas, such as kitchens or bathrooms, may not be suitable for art due to damp air or grime from cooking that might accumulate on the surface. Keep away from pressure on the surface when hanging or storing to not damage the canvas. Prints are best framed using a non-glare glass with a protective UV coating.

7.   Intellectual Property

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by James Tunney or Luxrosata, affiliates or licensors thereto and are protected by international conventions, copyright and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of James Tunney, Shopify or any third party. Unauthorised use of the Services may be a violation of intellectual property laws. All rights not expressly granted herein are reserved by James Tunney or Luxrosata.

Names, logos, product and service names, designs, and slogans are trademarks of James Tunney or Luxrosata or its affiliates or licensors. You must not use such trademarks without our prior written permission.

James Tunney asserts all moral rights to his works and also retains the relevant rights associated with the resale of original art.

Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify.

All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

8.   Optional Tools

You may be provided with access to customer tools offered by third parties on the Shopify platform as part of the Services, which we neither monitor nor have any control nor input over.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

9.   Relationship with Shopify

We are powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our shop are made directly with Luxrosata. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Luxrosata, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Luxrosata.

10.   Warranties

We do not give any warranties or guarantees in relation to our goods or services which is provided ‘as is’. However, if you have received a faulty item see the above segment on faulty goods and let us know as soon as possible. You acknowledge that all items may vary, particularly from a colour perspective, from how they are displayed on-screen and how they appear in reality and any such variations will not be considered as defects. Especially printing of gold, silver, bronze or other metallics will be replicated with a good substitute in re-production so you should expect variations from the image on-screen.

The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.

EXCEPT AS EXPRESSLY STATED BY LUXROSATA, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

11.   Limitations of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL LUXROSATA, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

12.   Indemnification

You agree to indemnify, defend and hold harmless Luxrosata, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (a) your breach of these Terms of Service or the documents they incorporate by reference, (b) your violation of any law or the rights of a third party, or (c) your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defence and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defence of indemnified claims, including by providing relevant documents.

13.   Privacy

Your privacy is important to us and we explain how we process your personal information in our Privacy Policy, available in the shop’s footer menu. Please read it for more information about our processing and your rights.

Please note that certain personal information may also be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you.

These terms and conditions shall be governed by, construed and enforced in accordance with the laws of Sweden, without regard to any conflicts of laws rules. The jurisdiction of Sweden shall apply and any dispute shall be brought in the Swedish district court of Gothenburg.
